CRIMINAL DEFENDANT CHARGED WITH 2ND DEGREE UNLAWFUL POSSESSION OF GUN ACCEPTED INTO PRETRIAL INTERVENTION PROGRAM
Jonathan Diego, Esq. (DIEGO LAW FIRM, LLC – Pleasantville) recently appeared in Superior Court with a client exposed to a maximum of 10 years in State prison (with a mandatory period of parole ineligibility), and maximum $150,000 in fines plus costs and fees.
Due to Mr. Diego’s ongoing discussions and negotiations with the Prosecutor, as well as his zealous advocacy, Mr. Diego’s client was admitted into the Pretrial Intervention (PTI) program. Also, the State agreed that Mr. Diego’s client would only be required to participate in PTI for 12 months (instead of the maximum 3-year PTI period). Once Mr. Diego’s client successfully completes the 12-month PTI period, the 2nd degree gun possession charge will be dismissed. Six months thereafter, Mr. Diego’s client can then file an application to expunge his arrest and gun charge.
